GERALD K. SMITH, Esq.
Areas of Practice: Mr. Smith is a partner
in the Finance and Bankruptcy Group of Lewis
and Roca. He has extensive experience in
the areas of bankruptcy, commercial litigation
and secured transactions.
Professional Activities: Mr. Smith has
been a member of the National Bankruptcy
Conference since 1970. In 1972-73, he served
as deputy director of the Commission on
the Bankruptcy Laws of the United States,
which produced the first draft submitted
to Congress of the current Bankruptcy Code.
Mr. Smith was a member of the Advisory
Committee on Rules of Bankruptcy of the
Judicial Conference of the United States
from 1993 - 1999. He was chair of its Subcommittee
on Rule 2014 Disclosure Requirements and
chair of its Subcommittee on Attorney Conduct
Rules. He was a member of its Litigation
Subcommittee and its Long Range Planning
Subcommittee. He was also a participant
in the Special Study Conference on Federal
Rules Governing Attorney Conduct (1996).
Mr. Smith was also a designated representative
of the Advisory Committee on Bankruptcy
Rules to the Subcommittee on Attorney Conduct
Rules of the Committee on Rules and Practice
of the Judicial Conference. He was a member
of the Ethics Working Group, the Partnership
Working Group, and the Tax Working Group
of the National Bankruptcy Review Commission
in 1997.
Mr. Smith is a former chairman
of the Board of
Directors of the American College of Bankruptcy, and Board of Regents, a distinguished organization
of nationally recognized experts in the
field of bankruptcy.
Mr. Smith has been a member of the American
Law Institute since 1989. He was an Adviser
to the Transnational Insolvency Project
and a consultant to the Restatement (Third)
for the Law Governing Lawyers and Restatement
of the Law, Suretyship. He was a member
of the UCC Permanent Editorial Board's Article
9 Study Committee from 1989-93. He was an
Observer of the Uniform State Law Commission Article 9 Drafting Committee.
Mr. Smith was a lawyer delegate to the Ninth
Circuit and has been on the Board of Directors
of the Ninth Judicial Circuit Historical
Society since 1988.
